1. Who you are contracting with

Bloomly (the "Service") is operated by Harold Jay Judd ("we", "us", "our"), trading as Bloomly. By creating an account or using the Service you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.

2. Acceptance

By continued use of Bloomly you confirm that you accept these Terms and have authority to do so (or are of legal age in your jurisdiction).

Bloomly provides AI-generated digital planners, habit trackers, weekly insights, and PDF exports. Features available depend on your subscription plan.

You must keep your account credentials confidential and provide accurate information. You are responsible for activity under your account.

7. Intellectual property

We retain all right, title and interest in the Service, including software, design, branding, and documentation. You retain ownership of the content you submit; you grant us a limited, worldwide, non-exclusive license to host and process that content solely to provide the Service to you.

8. Subscriptions, billing & refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment terms, billing frequency, taxes, renewals, cancellations and refunds are governed by Paddle's Buyer Terms and our Refund Policy.

9. Service availability

We work to keep Bloomly available and reliable but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, we disclaim all implied warranties (including merchantability and fitness for a particular purpose).

10. Suspension & termination

We may suspend or terminate your access if:

On termination, you may lose access to content stored in the Service. Where possible we will provide a reasonable window to export your data before deletion.

11. Liability

To the fullest extent permitted by law, our aggregate liability is capped at the fees you paid in the 12 months before the claim. We exclude liability for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence where such limitation is not permitted by law.

12. Indemnity

You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

13. Changes

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice.

14. Governing law

These Terms are governed by the laws of the seller's jurisdiction. Disputes will be resolved in the competent courts of that jurisdiction.
